Long March for Equal Rights to Dalit Christians

Subject: Request to urge the Union Government of India to implement the Report of NCRLM r, particularly to the Additional Term of Reference and to give a positive reply to the Supreme Court on Writ Petition 180/2004, to delete paragraph 3 of the Constitution (Scheduled Castes) Order 1950.
The Scheduled Castes in
The issue of Christians and Muslims of Scheduled Caste Origin was referred to the National Commission for Religious and Linguistic Minorities (NCRLM) or the Ranganath Misra Commission by the Union Government of India. It was done in the context of the Writ Petition 180/2004 and other petitions in the Supreme Court and the Counsel informed the Supreme Court about this on the 28th November 2005.
The NCRLM report was tabled in the Parliament on 18th December 2009. The important recommendations regarding the paragraph 3 of the Constitution of Scheduled Castes Origin are:
“…we recommend that Para 3 of the Constitution (Scheduled Castes) Order 1950 –which originally restricted the Scheduled Caste net to the Hindus and later opened it to Sikhs and Buddhists, thus still excluding from its purview the Muslims, Christians, Jains and Parsis, etc.- should be wholly deleted by appropriate action so as to completely de-link the Scheduled Caste status from religion and make the Scheduled Castes net fully religion-neutral like that of the Scheduled Tribes.” (16.3.5)
“We further recommend that all those groups and classes among the Muslims and Christians, etc. whose counterparts among the Hindus, Sikhs or Buddhists, are included in the Central or State Scheduled Castes lists should also be covered by the Scheduled Caste net. If any such group or class among the Muslims and Christians, etc. is now included in an OBC list, it should be deleted from there while transferring it to the Scheduled Castes-placing the same persons in the Scheduled Caste list if they are Hindu, Sikh or Buddhist but in the OBC list if they follow any other religion-which is the case in many States –in our opinion clearly amounts to religion-based discrimination.” (16.3.6)
On the 23rd January 2008, the Additional Solicitor General sought eight weeks to take a decision on the issues raised in the Writ Petitions. From 23rd January 2008 onwards, the Case has been posted number of times in such a way that it could not come for hearing. Now more than one and half years have passed. Justice is delayed due to the postponement of Union Government’s decision to give a reply to the Supreme Court. The next hearing is scheduled in January 2010.

- To urge the Union Government of India to give an appropriate answer to the query of the Supreme Court to the Writ Petitions demanding deletion of the unjust paragraph 3 of the Constitution Scheduled Castes Order 1950 and to extend Scheduled Caste status to Christians and Muslims of Scheduled Caste origin.

Let me join the chorus in appreciating the initiative of marching for Justice to our Dalit Christians and Dalit Muslims in TN.I hope this march shall impress upon the Central Government in ensuring justice to us. This march is yet another reminder to tell to us, we are not defeated and to affirm that Justice is always triumphant. In my opinion, dalits Christians/Muslilms should also be considered as dalit Hindus. I have seen thousand & thousand of cases, dalits Christians are more suffering in the country. Even, having one meal in a day is difficult for them. To control the hunger, they are having ‘pan’, tea, ‘cigrets’ and ‘tobacco’. They themselves are suffering a lot. They are not able to care of themselves (even now) in terms of health and welfare. Due to their broad mind and innocent thinking they have been exploited for several thousand of years in the country.
ReplyDeleteIn our country, mostly the scheduled castes and schedule tribes are ethnic Indians. But, most of their lives in India are still horrible. There are lots of literature and study which proves this point. Even, now, if we experiment/study also, we get the same/similar results. They are kept in the country as a very deprived/suppressive category. Though there are talks in the different media and public that there is no caste, but if we go and see deeper and deeper there are still untouchability feeling among the different people group. Despite, our nation is around 60 years old. The Caste problem still exists. Looking at these problems, sometimes, I do not feel like to celebrate our Independence /Republic day. Due to some growth of education they are coming up but not every one still!.
Every citizen should enjoy equal rights in this country and the Government should make sure of this equal rights to all its citizens. India is a secular and democratic county. Getting the rights at par with the same category is morality and justice. It is imperative that all dalit people, including Christian/Muslims , should enjoy the affirmative action programs of the Government in health, education and employment. It is the duty of the government to show justice for all kind of people in the country. Giving the equal status for them is the duty of the government.
In all respects, except religion, all dalits are in the category. Practicing the religious faith is the individual person's right in a secular country. He should not be deprived of the privileges based on religion. It goes against the secular nature of the country. So, I request the government to consider the Christians and Muslims in the SC/ST category. Also, I have a hope that justice is given at the earliest opportunity. Thank you.

I am pleased to present my sincere thanks and gratitude to all of you who had arranged the march, very specifically, on behalf of Christians and Muslims of Scheduled Castes Origin people, I want to praise and honour the people who are leading and participating in our righteous peace March for inheriting justice. At hand,with the grace of Almighty God and for his glory we are going to nullify and delete the abnoxious unconstitutional religious ban of the Paragraph 3 of the Constitution Scheduled Castes Order, 1950 which acts as a stumbling block to extend the Scheduled Castes status to Convert Christian and Muslim members of the enumerated Castes of India.Surely, this march will bring non violent political revolution to treat Dalit Christians and Dalit Muslims as Scheduled Castes legally and constitutionally. ReplyDeleteThe Thurumbar Liberation Movement is with you in this great and timely effort by all those concerned with this issue. We are only sad that we are not able to walk with you right from the start. But we the Puthirai Vannars(Thurumbars) are all with you and we shall join you on the road at the earliest. Hope this concerted effort will move the Central and State governments to immediately grant the long pending SC status to the Dalit Christians. We will intensify our struggle and shall not rest untill our basic right is obtained.
